MEDIATION

Mediation puts the decisions back in your hands. Instead of a judge ruling on your case, a neutral mediator helps you and the other party work toward an agreement you can both accept.

At Andersen Law PC, our mediation practice goes beyond the agreement. We meet with you as many times as needed and coach you through the legal paperwork so an agreement becomes a finished case. Note that while some of our mediators are attorneys, mediation is not legal advice.

What Is Mediation?

Mediation is a confidential, problem-solving process. A mediator is a neutral third party who helps you and the other party reach agreements on disputed issues. There is no judge, no jury and no ruling.

Mediators don’t take sides or give legal advice. Their job is to help both parties reach agreement. Learn how mediation works, how to prepare and what to expect.

Why Choose Mediation?

Mediation often resolves a case with less financial cost and conflict than a contested hearing. Benefits include:

  • More control. You and the other party shape the outcome instead of leaving it to a judge.
  • Lower cost. Successful mediation typically costs significantly less than preparing for and attending a contested hearing.
  • Less conflict. A cooperative process helps avoid the bad blood a trial can create, which matters most when you’ll keep co-parenting or dealing with each other.
  • Confidentiality. Offers, discussions and mediator notes are typically confidential and inadmissible in court, so everyone can talk candidly.
  • A faster path. Settling through mediation usually wraps up a case sooner than waiting for a hearing date.
  • Progress is made even without a full deal. Even a partial agreement narrows what’s left for court.

The Andersen Law PC Difference

Reaching an agreement isn’t the finish line. Our approach to mediation includes:

  • Meeting as often as needed. We don’t limit you to a single session.
  • Coaching through the process. We help you prepare, understand each step and stay focused on resolution.
  • Help with the paperwork. After you reach an agreement, we coach you through completing the legal forms.

Cases We Mediate

  • Divorce and family law: Disputed issues such as parenting time, child support, maintenance, and property and debt division.
  • Probate: Includes disputes among beneficiaries and personal representatives, including how the estate is handled and who gets which items.

Frequently Asked Questions About Mediation in Colorado

Is mediation the same as legal advice?

No. A mediator is neutral and doesn’t advise either party on the law or the likely outcome in court. Many people ask an attorney to review a proposed agreement before signing.

How many sessions will we need?

There’s no set number. We meet with you as many times as needed.

What happens after we reach an agreement?

The mediator typically drafts a memorandum of understanding capturing the terms, which can serve as the framework for your separation agreement and parenting plan. We then coach you through completing the legal paperwork.

Is mediation confidential?

Offers, discussions, and mediator notes are confidential and typically inadmissible in court, which encourages candid problem-solving.

Do you offer mediation in Spanish?

Yes. Crystal Andrade conducts mediation in Spanish.

Is mediation right for every case?

Mediation works best when both parties are willing to negotiate in good faith, and it can even be beneficial in high-conflict cases. In Colorado, the courts generally expect the parties to try mediation before moving on to a contested hearing.
